Maybe not if the other person was in the exact same state, but otherwise, it's definitely rape (the legal definition of which is something like: to force, coerce and/or engage in sexual activity without the other person's consent. And, yes, being in an unfit state to deny sex, does NOT mean it can be interpreted as consent - quite the opposite, actually).

But on a worse day, I could've given this a 3.5.

We've all read this kind of story before: the hitman/thief/gangster/pirate/elite soldier/etc. tries to live a quiet life... but his past soon catches up with him.
What sets this story apart is the Murim setting. Okay, there are other aspects too - it's not a C & V of some random '90s Hong Kong action flick - but the beats are all in there.
Honestly: I was really enjoying this until... around the time the translation team team changed - and changed everyone's names too, just for chuckles (damn, even the title changed from, Storm Inn, to, Stormy Inn. And why a General became an Admiral, I'll never know), and then it kind of lost its way, tried to cultivate into a proper Murim title, remembered it was a bit more grounded and about soldiers surviving Hell, trying to live life afterwards, flunked the final "war" chapters and just kind of ended.

This may seem like I'm purposely trying to turn you off, but the first 2/3s of this are so damn good, I'd still recommend it!
The rest of what I wrote is more of a warning: this tremendous, cool comic, after starting at such a high bar, will leave you disappointed... but you'll know it's because, when at the top, the only one way to go is down, so you'll give it some leeway.

Still, it was good while it lasted.
