Both. And it is quite complex, because it is not made to deter perverts or limited to photography. It applies to all forms of visual or audiovisual recordings and includes all non public figures, public figures in their private life, and private property.
So basically paparazzi (lowly wretches who should be considered worse than thieves) in Japan often risk going to jail. Same for journalists and influencers (both the scum of the earth) who record inside venues without authorization.
